Terms of Service

These terms govern the coaching services and website provided by Fransois Fourie, trading as Parabellum Elite Fitness Academy (also known as “The Diamond”) — a sole proprietor in Mossel Bay, South Africa (“we”, “us”). By enquiring, applying, or purchasing coaching, you (“you”, “the client”) agree to these terms.

1. The service

We provide online physique and contest-prep coaching — which may include training programming, nutrition guidance, posing coaching, check-ins and peak-week / show-day guidance, as described in your specific package. Coaching is educational and advisory. It is not medical, physiotherapy, or psychological treatment (see the separate Medical & Health Disclaimer).

2. No guarantee of results

Physique results depend heavily on your genetics, adherence, consistency, sleep, stress, health and other factors outside our control. We do not and cannot guarantee any specific result, placing, weight, or outcome. Any examples or testimonials are illustrative, not promises.

3. Eligibility & your responsibilities

You confirm you are 18 or older.
You confirm you are medically cleared to train and diet as programmed, and you will obtain a doctor’s clearance where appropriate.
You will give honest, complete information about your health, history, medications and circumstances, and update us if things change.
You are responsible for how you follow (or don’t follow) the coaching, and for your own choices — including any decision to use, or not use, any supplement or substance, and for the legality of those choices in your jurisdiction.

4. Fees, payment & cancellation

Fees, billing period and inclusions are set out in your coaching agreement / at sign-up. Prices are in South African Rand (ZAR) unless stated otherwise.
Payment is arranged directly with you after your application is accepted (e.g. EFT or invoice), and is due per the agreed schedule. We do not process card payments through this website.
Refunds: coaching fees are non-refundable once a coaching block has started, because the program is prepared specifically for you. If your circumstances change, contact us and we’ll handle it fairly.
Either party may end coaching with 14 days’ notice. Fees already paid for a started period are non-refundable per the above.

5. Intellectual property

Programs, plans, videos and materials we provide are for your personal use only. You may not copy, resell, share or redistribute them without our written permission.

6. Assumption of risk

Resistance training, dieting, cardio and competition preparation carry inherent risks (including injury and health effects). You take part voluntarily and assume these risks. You agree to stop and seek medical advice if you experience pain, illness, or warning signs.

7. Limitation of liability

To the maximum extent allowed by law, we are not liable for any indirect or consequential loss, or for outcomes arising from your health, choices, adherence, or matters outside our control. Nothing in these terms limits liability that cannot lawfully be limited. Our total liability is limited to the fees you paid for the coaching period in question.

8. Conduct

We can decline or end coaching (for example, for abusive behaviour, dishonesty about health, or non-payment). We coach natural and enhanced athletes without judgment, but we do not prescribe, supply, or source any medication or controlled substance (see the Medical & Health Disclaimer).

9. Governing law

These terms are governed by the laws of the Republic of South Africa, and disputes are subject to its courts.
